BYOMA OPEN CASTING TERMS & CONDITIONS 

BYOMA 2025 CASTING CALL (“Casting Call”) 

THIS IS NOT A COMPETITION, PRIZE DRAW, GIVEAWAY OR PROMOTION.  

THESE TERMS AND CONDITIONS, AND YOUR APPLICATION AND SUBMISSION, CONSTITUTE A CONTRACT BETWEEN YOU AND BYOMA LIMITED.  

These terms and conditions apply to residents of the United Kingdom, Ireland and the United States of America. If you are resident in France, please refer to the French terms and conditions COMMUNITY CAMPAIGN TERMS & CONDITIONS French – BYOMA

  1. BYOMA’S 2025 LAUNCH 

BYOMA is a skincare brand that celebrates diversity in beauty and is looking for individuals who best embody that attitude and diversity to represent our brand. 

BYOMA Limited (“BYOMA” or “we”) is launching our 2025 community campaign.  

We will be choosing passionate BYOMA fans from our community to create content for use in a new brand campaign (the “Campaign”), which will be used across social media and online platforms.  

A reference to “you” or the “Participant” is to the person who submits an application form for entry this Casting Call.  

BYOMA will review applications and Submissions (see below) and will select the participants to take part in the sample product stage of approximately 4 weeks (“shortlisted Participants”). Then BYOMA will review Progress Submissions (see below) and select the Participants to take part in our Campaign (the “Selected Participants”) from the shortlisted Participants. 

We will send the relevant BYOMA sample products to the shortlisted Participants. The shortlisted Participants will be asked to use the sample product range for four weeks and to document their experience through progress photos and a short vlog capturing honest results and feedback (“Progress Submissions”. Participants have the option to cease participation at any time. If a shortlisted Participant does not submit the photos and vlog, BYOMA may elect not to consider that shortlisted Participant as a potential Selected Participant. 

We will be prioritising diversity in our final selection, not traditional beauty standards. Everyone who meets the entry criteria below is invited to apply regardless of gender, gender identity, or gender expression. 

  1. WHO CAN ENTER? 

The Casting Call is open only to legal residents of the United States of America, United Kingdom, Ireland, and France who have (i) validly submitted an entry as described below, and (ii) (at the time of submitting an entry) are of legal contracting age in their country or state of residence or have the consent of a parent or guardian to enter the Casting Call.

Eligibility to be selected as a shortlisted Participant or Selected Participant is contingent upon complying with and fulfilling all requirements set out in these terms and conditions and in the application form/Questionnaire for the Casting Call. 

PARTICIPATION IN THIS CASTING CALL ONLY PROVIDES AN OPPORTUNITY FOR PARTICIPANTS TO BE CONSIDERED IN THE FIRST STAGE. THIS CASTING CALL DOES NOT GUARANTEE THAT ANY PARTICIPANT WILL BE SELECTED AS A SHORLISTED PARTICIPANT OR SELECTED PARTICIPANT. YOU UNDERSTAND AND AGREE THAT BYOMA HAS THE RIGHT TO SELECT ANY PARTICIPANT IT CHOOSES (IF ANY) AS A SHORTLISTED PARTICIPANT OR SELECTED PARTICIPANT. 

  1. HOW CAN YOU ENTER? 

The entry period for this Casting Call opens at 12:00 USA Eastern Standard Time (“EST”) on 29th May 2025 and ends at 11:59 EST on 1st June 2025 (the “Application Period”). 

During the Application Period, you must visit the LANDING PAGE (“Site”) and (1) fill out the questionnaire (TYPEFORM ENTRY) (“Questionnaire”); (2) upload a photo, posing straight on to the camera (“Photo”); and (3) submit all information requested in the entry form, which includes your name, e-mail address, mailing address, Instagram account, and other information about you, and the parent or guardian consent form if needed (“Entry Information”).  

All entry information, videos, photos, and other information submitted by a Participant at any time are collectively referred to as the “Submission”. All videos and photos should have a plain background and bright, natural lighting and must be in .jpg format and less than 3MB in size.  

No other method of participation will be accepted.  

Submissions that do not follow these terms and conditions may be disqualified at BYOMA’s discretion. 

All of BYOMA’s determinations of eligibility shall be final and binding. BYOMA may or may not provide Participants with any confirmation of Casting Call entry or receipt of any Questionnaire or Submission or Progress Submission. 

NO PURCHASE OR PAYMENT OF ANY KIND IS REQUIRED TO ENTER THE CASTING CALL AND MAKE A SUBMISSION.   

BYOMA will not return your Submission to you. 

  1. HOW DO YOU OBTAIN PHOTOGRAPHY EQUIPMENT? 

BYOMA will not provide any equipment for the initial video entries; Participants must provide their own video(s). 

BYOMA will be providing photography equipment: (1) a phone ring light; and (2) an “Octobuddy” (“Equipment”) to each of the shortlisted Participants. No equipment will be provided to other Participants. 

No purchase or payment of any kind is required for shortlisted participants to receive the Equipment. 

How is the Equipment delivered? 

BYOMA will be responsible for the transportation of the Equipment to the shortlisted Participants. BYOMA will organise delivery of the Equipment to the shortlisted Participants once they are selected. Equipment will be delivered to the address provided in the entry form. 

The Equipment is not required to be returned to BYOMA. 

  1. HOW DO YOU OBTAIN AND USE THE SAMPLE BYOMA PRODUCTS? 

BYOMA will be providing the relevant sample BYOMA products to be tested by each of the shortlisted Participants (“Products”) These Products are provided free of charge. These Products are subject to terms of use provided to you with the Products. The terms of use of Products include instructions for use including how and when you should, or should not, use the Products. You must comply with the terms of use for Products. 

BYOMA will only supply the relevant sample Products to be used for the Campaign. No other BYOMA products of any kind shall be provided. Only the shortlisted Participants are entitled to receive the sample Products. 

Shortlisted Participants must use the sample Products in accordance with the directions provided by BYOMA. You should use only the sample Products in your skincare regime during the four-week period. If a shortlisted Participant does not use the sample Products in accordance with BYOMA’s directions or uses alternative or additional products in your skincare regime, BYOMA may disqualify the shortlisted Participant from the Casting Call or the Campaign.  

How are the Products delivered? 

BYOMA will be responsible for the transportation of the Products to the shortlisted Participants. BYOMA shall organise delivery of the Products to the shortlisted Participants once they are selected. Products will be delivered to the address provided in the entry form. 

  1. HOW ARE SELECTED PARTICIPANTS CHOSEN? 

SHORTLISTING STAGE 

The decision as to which Participants will be considered as shortlisted Participants will be made as follows: 

A panel of representatives from BYOMA will review all Submissions properly submitted and received during the Application Period. The BYOMA panel will choose Participants to be shortlisted in its sole discretion, taking into account the information provided by the Participants in the Submissions.  

Selection of shortlisted Participants will take place throughout the Application Period and is scheduled to be completed on or around 4th June 2025.  

Participants will not be notified unless they become shortlisted Participants.  

BYOMA requests that each shortlisted Participant please respond with a courtesy notification as to whether the shortlisted Participant will participate in the use of sample BYOMA products. If no notification is received within seven days of BYOMA’s second attempt to contact the shortlisted Participant, then the shortlisted Participant will be deemed to have declined to participate. 

The total number of shortlisted Participants selected by BYOMA shall be at BYOMA’s sole discretion. The decisions of BYOMA will be final and binding in all matters related to the Casting Call and the Participants who are chosen to be shortlisted Participants. 

No draws, sweepstakes, raffles, or other elements of chance are used to determine the shortlisted Participants or Selected Participants. 

All shortlisted Participants must be available during the period of 4th June 2025 to 5th July 2025 for the use of the sample BYOMA products.  

  1. WHAT DO YOU NEED TO DO IF YOU ARE A SHORTLISTED PARTICIPANT? 

Each shortlisted Participant must produce the required content for the Progress Submission by 5th July 2025 in order to be considered to become a Selected Participant.  

The required content will be: (1) at least five (5) progress photographs (including a before image, progress images, and a final image); and (2) one, two or three video clips of no more than one (1) minute each. If you do not submit all of these on time, then BYOMA may exclude you from consideration to be a Selected Participant. 

There will be no prize or payment for providing the required content to us. The consideration for this is our provision of the sample BYOMA Products. 

  1. HOW ARE SELECTED PARTICIPANTS CHOSEN? 

From the shortlisted Participants a panel of representatives from BYOMA will review the Progress Submissions and select a final set of Selected Participants for proposed participation in the Campaign, along with an additional set of back-up Participants from the shortlisted Participants. The Selected Participants will be chosen by the panel of representatives from BYOMA and invited to participate in the Campaign. 

  1. HOW WILL YOU BE NOTIFIED OF BEING A SELECTED PARTICIPANT? 

BYOMA will make up to two (2) attempts to notify each Selected Participant of their selection via the email address provided in that Selected Participant’s Questionnaire. BYOMA is not liable if the Selected Participant is not reached or receives such notification too late to take part in the use of the sample BYOMA products from 4th June 2025 to 5th July 2025 due to an incorrect email address given by the Participant or technical issues beyond our control (e.g. spam filters, server failures, etc.).  

BYOMA requests that each Selected Participant please respond with a courtesy notification as to whether the Selected Participant will participate in the Campaign. If no notification is received within seven days of BYOMA’s second attempt to contact the Selected Participant, then the Selected Participant will be deemed to have declined to participate in the Campaign. 

BYOMA makes no representations or warranties that all Selected Participants will be able to participate in the Campaign and reserves the right, in its sole discretion, to decide whether to invite additional or alternative Participants to participate in the Campaign if any Selected Participant cannot, or declines to, participate. 

  1. WHAT LEGAL AGREEMENTS DO SELECTED PARTICIPANTS NEED TO SIGN?  

As conditions of participating in the Campaign, each Selected Participant will be required to execute (1) a non-disclosure agreement, (2) an image use authorisation, (3) a copyright assignment and/or any (4) other documents requested by BYOMA and necessary for the Campaign (e.g., parental consent).  

You retain the copyright, image rights and other rights in your Submission and your Progress Submission. If your Submission or Progress Submission is used in the Campaign you may be required to assign those rights in a legal agreement. The image use authorisation and copyright assignment shall take into account the purposes of the Campaign, the duration of the Campaign, the countries in which the Campaign will be communicated, and the media on which the Campaign will be carried out. 

Participation in the Campaign and assignment of copyright will entitle the Selected Participants to a payment, the amount of which will be specified in the assignment agreement to be concluded. 

Such documents must be signed and returned by the Selected Participant in accordance with BYOMA’s instructions (which will be given when such documents are delivered to the Selected Participant) within 2 days. If the documents are not so signed and returned within this timeframe, or if a Selected Participant does not comply with these terms and conditions or is found to be ineligible, each as determined by BYOMA in BYOMA’s sole discretion, then the Selected Participant will be disqualified, will not be allowed to participate further in the Casting Call or Campaign, and BYOMA may, in its sole discretion, select a new Selected Participant from the shortlisted Participants. 

  1. WILL PARTICIPANTS BE PAID? 

Participants will not be paid unless they become Selected Participants and sign and comply with the legal agreements referred to in Section 10 above. 

Selected Participants will be paid for BYOMA’s usage of the Submission or Progress Submission and the assignment of copyright. This will be covered by the legal agreements referred to in Section 10 above.  

  1. CAN YOU SHARE PRODUCTS OR INFORMATION ABOUT THE CAMPAIGN? 

No, you may not.  

THE SHORTLISTED PARTICIPANTS MAY NOT SELL, GIFT OR ALLOW OTHERS TO USE THE PRODUCTS. 

The shortlisted Participants and Selected Participants may not disclose any details of the sample Products or the Campaign until after the official launch of the Campaign. 

  1. IDENTIFICATION, PHOTOGRAPHS AND SUBMISSIONS 

  1. Only Participants who can verify via photo ID that they are the party who submitted the selected Submission will be allowed to participate in the Casting Call and, if selected, the Campaign. 

  1. BYOMA will retain Questionnaires, application forms, Submissions and Progress Submissions for up to 12 weeks from receipt of each by BYOMA. BYOMA will delete them no later than the end of such 12-week period unless BYOMA wishes to use Selected Participants’ application forms, Submissions and/or Progress Submissions in the Campaign. In that case BYOMA will provide further information about retention and usage in the legal agreements referred to in section 10 above.,  

  1. LEGAL 

  1. PERSONAL DATA 

  1. BYOMA will only use your contact details to contact you for reasons relating to this Casting Call or otherwise in accordance with BYOMA’s privacy policy: Privacy Policy | BYOMA. 

  1. By participating in the Casting Call, you acknowledge BYOMA’s collection and usage of any personal data included in the Submission, Progress Submission and your application form and Questionnaire and you acknowledge that you have read BYOMA’s privacy policy.  

  1. As part of the application form/Questionnaire, BYOMA asks you to explicitly consent to the processing of special category personal data (which may include personal data relating to health conditions, race, ethnicity, sexuality or sexual orientation). BYOMA will only process your special category data for the purpose of assessing Submissions and Progress Submissions. If you do not consent to the processing of special category personal data for the purposes described in these terms and conditions then you should not participate in the Casting Call. 

  1. If any special category personal data is to be processed for use in the Campaign, such processing will be covered in the legal agreements referred to in Section 10 above. 

  1. In some countries, to comply with legal obligations BYOMA may be required to make available the surname and county of Selected Participants and, in some cases, copies of the Submissions. 

  1. If you object to any or all of your surname, county or Submission being made available, please contact BYOMA [info@byoma.com]  

  1. Even if you object, in some circumstances, in some countries, BYOMA must still provide the information and Submissions and Progress Submissions of Selected Participants to the relevant authorities. 

  1. RELEASE 

  1. By completing and submitting the application form and any Submission, you agree (to the extent permitted by law) to release and hold harmless BYOMA, and its parents, affiliates, subsidiaries, assigns, directors, officers, employees, and agents, its advertising and promotion agencies, and any other persons or entities related to the Casting Call (collectively, “Releasees”) from any and against all claims, injuries, damages, expenses, or losses to person or property and/or liabilities of any nature that in any way arise from participation in the Casting Call, including without limitation (i) any condition caused by events beyond any of the Releasees’ control that may cause the Casting Call to be disrupted, postponed or cancelled other than those caused by the wilful negligence or intentional misconduct of a Releasee; (ii) any losses or damages (compensatory, direct, incidental, consequential, or otherwise) of any kind arising in connection with or as a result of participation in the Casting Call other than those caused by the wilful negligence or intentional misconduct of a Releasee; and, (iii) any printing or typographical errors in any materials associated with the Casting Call.  

  1. This clause does not affect any statutory rights you may have as a consumer under applicable law. 

  1. LIMITATION OF LIABILITY 

  1. BYOMA is not responsible for (i) late, lost, delayed, damaged, incomplete, illegible, misdirected or undeliverable entries or Submissions, responses, or other correspondence, whether by e-mail or postal mail or otherwise; (ii) theft, destruction, unauthorised access to or alterations of application forms, Questionnaires or Submissions; or (iii) phone, electrical, network, computer, hardware, software program, or transmission malfunctions, failures or difficulties. BYOMA is not responsible for electronic communications that are undeliverable as a result of any form of active or passive filtering of any kind, or insufficient space in Participant’s e-mail account to receive e-mail messages. 

  1. BYOMA’s maximum liability to you under or in connection with the Casting Call, whether arising in contract, tort (including negligence) or otherwise shall be limited to £2,000 in aggregate.  

  1. Notwithstanding anything to the contrary herein, in no event shall any Participant seek or be entitled to rescission, injunctive or other equitable relief or to enjoin or restrain the production, distribution, exhibition, operation or other exploitation of the Campaign or any BYOMA products or other campaigns, the Casting Call, any website, any social media or other content, advertising or other materials used, displayed or issued in connection with the Casting Call, the Campaign or any other BYOMA campaign, or any Submission or entry, and such Participant’s rights and remedies in any such circumstance or event shall be strictly limited to the right to recover money damages, if any, in an action at law.  

  1. In no event will BYOMA be liable for any direct or indirect, special, incidental, exemplary, punitive or consequential loss or damages arising out of or in connection with the Casting Call or Campaign, whether such liability arises from any claim based upon contract, warranty, tort (including negligence), strict liability or otherwise, and whether or not BYOMA has been advised of the possibility of such loss or damage.  

  1. THE ABOVE EXCLUSIONS AND LIMITATIONS MAY NOT APPLY TO YOU IF YOU ARE A RESIDENT OF A STATE OR TERRITORY THAT DOES NOT ALLOW THE EXCLUSIONS OR LIMITATIONS SET OUT ABOVE, BASED ON APPLICABLE STATUTORY RIGHTS OF A CONSUMER.  

  1. GENERAL CONDITIONS 

  1. BYOMA reserves the right, in its sole discretion and without liability to the Participant, to cancel, modify or suspend the Casting Call or Campaign in whole or in part.  

  1. BYOMA reserves the right to disqualify any Participant at any stage, for objective reasons, such as non-compliance with these terms and conditions, without liability to the Participant.  

  1. The Casting Call is void where prohibited or restricted by law.  

  1. The Casting Call and the contract between the Participant and BYOMA shall be governed by and construed in accordance with the laws of England and Wales, provided that any Participants who are acting as consumers are not deprived of the protection offered by the mandatory rules of their countries of residence.  

  1. Subject to the following sentence, any disputes, issues, legal actions, suits or proceedings related to the Casting Call (whether for breach of contract, tort, negligence or otherwise) will be brought exclusively in the English Courts, provided that any Participants who are acting as consumers are not deprived of their choice to bring proceedings to the Court of the place of actual delivery of the service. Indeed, in certain jurisdictions consumer law requires legal actions, suits or proceedings to be brought in courts local to you and, if that is the case, we and you submit to the exclusive jurisdiction of those courts.   

  1. FORCE MAJEURE 

  1. Without limiting any other provision in these terms and conditions, in the event that a Participant’s activities or BYOMA’s operations or activities are affected by circumstances beyond their reasonable control, without limitation, by reason of any acts of God, any action, regulation, order or request by any governmental or quasi-governmental entity (whether or not the action, regulations, order or request proves to be invalid), equipment failure, threatened terrorist acts, terrorist acts, air raid, blackout, act of public enemy, earthquake, war (declared or undeclared), fire, flood, epidemic or public health crisis (e.g. COVID-19), explosion, unusually severe weather, hurricane, embargo, labour dispute or strike (whether legal or illegal) labour or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot, or any law, rule, regulation, order or other action adopted or taken by any governmental authority, or any other event of a similar nature, whether or not specifically mentioned above, BYOMA reserves the right, acting reasonably and proportionately, to modify, suspend, or cancel the Casting Call or Campaign, without incurring liability to the Participant. 

  1. MISCELLANEOUS 

  1. The invalidity or unenforceability of any provision of these terms and conditions shall not affect the validity or enforceability of any other provision. If any of these terms and conditions is determined to be invalid or otherwise unenforceable or illegal, these terms and conditions shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. BYOMA’s failure to (or decision not to) enforce any provision in these terms and conditions shall not constitute a waiver of that or any other provision. If there is a discrepancy or inconsistency between the application form, Questionnaire, FAQs or other statements contained in any Casting Call-related materials and these terms and conditions, these terms and conditions shall prevail, govern, and control and the discrepancy will be resolved in BYOMA’s sole and absolute discretion.
